Our Demand
To Justices of the Supreme Court of the United States:
We, the undersigned, respectfully urge the Court to uphold the authority of the United States to remove Mahmoud Khalil, and to allow his removal to Algeria to proceed.
The Facts
- Mahmoud Khalil is not a U.S. citizen. He holds lawful permanent resident status, which under federal law can be revoked on grounds set by Congress.
- He was a lead negotiator and spokesman for Columbia University Apartheid Divest during the 2024 campus encampments.
- In March 2025, federal immigration authorities detained him and began removal proceedings.
- An immigration judge later found him removable and ordered his removal to Algeria, or in the alternative to Syria.
- His case has since moved through the federal courts, where it has been argued on jurisdictional and constitutional grounds.
What He's Accused Of
Mahmoud Khalil became a prominent figure in Columbia University's protest movement, which was marked by allegations of antisemitic intimidation, the violent occupation and vandalism of Hamilton Hall, and the circulation of propaganda produced by Hamas, the terrorist organization responsible for the October 7 massacre, in which civilians were murdered, sexually assaulted, and taken hostage, including children and elderly people, among them Holocaust survivors.
Federal authorities have accused Khalil of distributing Hamas-linked propaganda, while civil plaintiffs have alleged coordination between campus activists and Hamas. Khalil disputes wrongdoing. These serious accusations raise urgent questions about his personal conduct, organizational relationships, and whether any activities crossed the line from protected political expression into unlawful support for a terrorist organization.
Why He Must Go
Removal belongs in immigration court. Congress sent challenges to removal orders through the immigration courts and then the courts of appeals. Letting district courts step in out of order undercuts the system Congress designed.
A green card is conditional. It is a privilege granted on the basis of truthful applications. Material misrepresentation is an independent, long-established ground for removal, separate from any question of speech.
No one is above the law. Non-citizens who break the conditions of their status face removal every day. A high profile should not buy an exemption.
What We're Asking
Respect the law Congress wrote. Let the removal order be carried out.
